The CP15 Common Practice delivers a set of principles on the comparison of goods and services, more specifically, on the treatment of terms lacking clarity and precision and the common interpretation of the Canon criteria and other factors. It was jointly developed by the EUIPO, the Member States’ IPOs, the Benelux Office for Intellectual Property (BOIP), User Associations and WIPO. The EUIPO, the BOIP, and 23 MS IPOs have adopted the CP15 Common Practice, which is available in 22 EU languages on the EUIPN website. This webinar will explain the principles of the CP15 Common Practice which serves as guidance to ensure that the comparison of the goods and services is assessed in a consistent manner by the EUIPO, MS IPOs and the BOIP. During this webinar, you will learn the following: 1. Treatment of terms lacking clarity and precision: • Key concepts: Clarity and precision in describing goods and services; Literal interpretation of the goods and services • Relevant case-law and derived principles • The underlying principles on which the Common Practice is based 2.
